Lis Pendens

Definition

A legal notice filed in public records indicating pending litigation affecting property title, most commonly foreclosure proceedings. Clouds title and prevents sale until the litigation is resolved. Buyers should avoid properties with active lis pendens.

Example

A lis pendens is filed when a lender initiates foreclosure. The property cannot be sold with clear title until the foreclosure is completed or the loan is brought current. This is a major red flag for buyers.
