Clouded Title

Definition

A property title with unresolved issues, liens, encumbrances, or ownership disputes that prevent clear transfer. Must be resolved before closing can proceed. Title insurance protects against undiscovered title defects.

Example

A clouded title might include an unresolved mechanic's lien from 2018, an easement dispute with a neighbor, or questions about a previous owner's right to sell. These must be cleared before closing.
