Title Defect

Definition

Any claim, lien, encumbrance, or legal issue that impairs clear ownership or marketability of property. Must be resolved before closing. Title insurance protects against undiscovered title defects.

Example

Title defects include: unresolved mechanic's lien, easement dispute, ownership question from previous transfer, or boundary dispute. These must be cleared or insured against before closing.
