Buyer Representation Agreement

Definition

The mandatory written contract between a buyer and their agent, required in Massachusetts before touring homes or writing offers (effective August 2024). Defines the exclusive relationship term, geographic scope, services provided, and critically, the exact compensation rate/amount the buyer owes their agent.

Example

Before touring Winchester homes, you sign a 90-day Buyer Representation Agreement with 2.5% compensation. This sets your maximum liability—you'll either secure this as a seller concession in your offer, or pay it directly at closing if the seller refuses.
